At Montage Legacy, we recognize that the photographs, slides, and videos you entrust to us represent your most precious family memories. We are committed to protecting your personal information and handling your physical and digital media with the highest standard of care, privacy, and respect.
Terms of Service & Legal Disclaimers
1. Limitation of Liability
To the maximum extent permitted by applicable law, Montage Legacy, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, emotional distress, or loss of profits arising out of or related to our services.
Under no circumstances shall the total aggregate financial liability of Montage Legacy exceed the actual dollar amount paid by the customer for the specific service rendered.
2. Media Handling & Loss Disclaimer
While Montage Legacy exercises extraordinary care and industry-standard precautions when handling physical photographs, slides, negatives, and digital media, all customer materials are submitted at the customer's own risk.
Montage Legacy is not liable for loss, damage, or destruction of physical or digital media resulting from events beyond reasonable control, including but not limited to inherent decay, pre-existing physical damage, mechanical equipment failure, shipping/courier loss, fire, natural disasters, or theft. In the event of damage or loss caused by proven negligence, liability is strictly limited to the replacement cost of equivalent raw, unexposed media.
3. Client Warranty & Copyright Indemnification
By submitting any physical or digital photos, video footage, audio, or text to Montage Legacy, you warrant and represent that you are the sole legal owner of the media or have obtained express written permission from the legal copyright holder to reproduce, scan, edit, and digitize the content.
You agree to defend, indemnify, and hold harmless Montage Legacy, its owners, and its affiliates against any and all claims, lawsuits, damages, attorney's fees, or liabilities arising from copyright infringement, privacy violations, or unauthorized use of materials provided by you.
4. Revisions, Non-Refundable Labor, & Satisfaction
All services, custom video rendering, and photo restorations are non-refundable once work has commenced. Montage Legacy provides up to two (2) rounds of minor revisions within seven (7) days of initial digital delivery to resolve reasonable client requests. Dissatisfaction with aesthetic preferences, artistic style, or pre-existing low-quality source material provided by the client does not constitute grounds for a financial refund or legal claim.
5. Governing Law, Venue, & Mandatory Individual Arbitration
These Terms and any disputes arising out of or related to Montage Legacy’s services shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
Any dispute, controversy, or claim arising out of or relating to this contract, or the breach thereof, that cannot be resolved informally shall be settled by binding individual arbitration administered in Riverside County, California, or through local Small Claims Court. You agree to resolve all disputes solely on an individual basis and explicitly waive any right to bring, join, or participate as a plaintiff or class member in any class action lawsuit, class-wide arbitration, or representative proceeding against Montage Legacy or its owners.
Montage Legacy exercises extreme care when handling physical photos and slides. In the unlikely event of loss or damage to physical media due to circumstances beyond reasonable control, liability is limited to the cost of replacing raw, unexposed materials or refunding the service fees paid.
